Supreme Court May Take Case That Would Restore Concealed Carry in NJ

The Supreme Court will decide this Thursday whether or not to take a case that could strike down New Jersey’s draconian concealed carry laws once and for all. The case, Peruta v. California, has been rescheduled twice for conference. Possibly indicating that the justices were awaiting for Neil Gorsuch to be confirmed before taking the case. If taken, the case could strike down New Jersey’s “justifiable need” scheme, which denies carry permits to everyone but the privileged and powerful while leaving women like Carol Bowne hopeless and eventually murdered.

The case asks the Supreme Court a simple question.

“Does the Second Amendment entitle ordinary, law-abiding citizens to carry handguns outside the home for self-defense in some manner, including concealed carry when open carry is forbidden by state law.”

Originally the 9th circuit ruled in favor of the Second Amendment, but that was quickly struck down as the full 9th circuit decided it was necessary to band to together to reverse that ruling in order to protect California’s gun control scheme. The case has now almost made it all the way the the Supreme Court.

It is scheduled for conference this Thursday, April 13, 2017, for the justices to decide whether they want to answer this question. This question is long overdue. We will find out if they take the case the following Monday, the 17th. The Supreme Court has not taken a single Second Amendment case since 2010 and the lower courts have no idea what to do on Second Amendment. It’s time for the Supreme Court to finally answer this question and straighten out the lower courts, who have completely ignored the Second Amendment at all costs in order to preserve gun control laws at the expense of the rights of the people.

Only four justices have to vote in the affirmative to take the case. The issue may be whether or not they believe they have the five votes to ensure they can strike down this law. But now, with Neil Gorsuch, hopefully they have revived energy for the case. We’re very hopeful that the Supreme Court will take this case and strike down California’s laws, because that would strike down New Jersey’s laws as well.
